MINUTES FROM THE OCTOBER 07, 2002 SELECT BOARD MEETING

 

Board members present were Dave Johnson, Pete Siegel, Jerry Mullen and John Devine. Also present was Town Clerk Deborah LaRiviere. The meting was called to order at 6pm.

 

Gene Armstrong met with the Board to discuss his concerns over the construction of a covered bridge on the Vita property. The bridge spans Joiner Brook and Armstrong feels high water, flooding or other issues may present a problem and if the bridge collapses, there will be serious problems down stream. The Vita’s have a permit for a temporary logging bridge issued in 1998. The Board would like Dick to investigate and get back to them.

 

Dana Farley came in to update the Board on her Village 2 zoning project. She presented a first draft topographical map with elevations, and present development. She asked the Board what their vision for that zoning district would be. The Board is seeking a strong recreational and commercial dis-trict with minimal residential, possible clustering or PRD’s. The density should be concentrated around the ski area. Farley also informed the Board that the Resort’s Water and Sewer were going to be in violation on Novem-ber 1st. for not complying with state requirements for septic area increases. Since the Town issues permits for new construction with approval from the water and sewer department itself, she suggested we request confirmation of state approval as well. Deb will have Dick speak with Farley.

 

At this point Road Foreman Eric Andrews joined the meeting. The Board read a letter from Neidi Ruelle regarding Mill Brook Road and the upcoming winter. (File: Correspondence) There are plans for some work on Mill Brook Road, but finances and time are making it impossible for this to get done before this winter. Without the removal of the ‘island’ at the top of the road, Andrews doesn’t feel it’s safe to use the large vehicles for plowing. Since the only other alternative is the 1-ton, this usually means the tail end of the road gets plowed later than other roads in town. The Board feels an evaluation of the work needed on this road would be best achieved by having a profess-ional engineer working with the town crew. Perhaps Dick Phalen would be available. Deb will contact him. In the meanwhile, Deb should draft a letter to the Ruelles responding to their concerns. Eric would also like advice on where to place ‘Town Highway Ends’ signs. Deb should ask Phalen to include that in his appraisal of our highway issues.

 

Robert Atchinson met with the Board to discuss the recent violation letter sent to him. Jay Rubin and Phil Graff, neighboring residents on Mill Brook were also present. Atchinson said he has done an inventory of items on his property and finally feels some should be disposed of. He feels a fence is out of the questions, cost wise as well as the ability to meet town setbacks. He claims he was denied a fence previously when he applied for one for his horses. He also doesn’t feel that anything on his property inhibits the site distances for vehicles traveling on the road, although the board feels differently. He said some of the vehicles were inspected, but not all; how-ever, they were all registered. He was informed by the Board that any

vehicles left on the property need to be registered and inspected, if not they need to go. Also, any other belongings need to be removed, such as boats, trash, furniture et cetera. He has told that penalties will be imposed. The neighbors concurred that they would like to see a ‘good faith effort’ on Atchinson’s part that the mess is being cleaned up. The Board will do a site visit on October 31st.  Atchinson said he would like to bring up the issue of 4-wheelers and their constant noise and the riders lack of concern for safety. Pete directed him to contact the Vermont State Police. Phil Graff then asked the Board about reducing the speed limit on the road. The speed limit (35mph) is the lowest it can be set without a traffic study. Graff said he’d be happy with children at play signs. Deb will tell the highway department.

 

Treasurer’s Reports were read. The Board would like the purchase of the new 1-ton moved from the vehicle payment line to a line of its own. Deb will do.

 

The Board asked Deb to inform Robert Fletcher, Esquire that taxes for Bolton Valley Holiday resort had not been paid in case the bankruptcy court needs to know this.

 

Deb gave the Board the draft of license for the skating rink. The Board will read and discuss on October 21.

 

There was no other business to be brought before this Board at this time.

Jerry motioned to end the meeting, seconded by John. The meting closed at 8:30pm.
