Meeting called to order at 6:14 p.m.

Agenda Item #1 – Minutes

Jim Bralich made a motion to accept the minutes of April 16, 2002 as amended.  Rodney Pingree seconded the motion.  All were in favor.

 

Agenda Item #2 – Other communications/mail

Linda Baker noted a May leadership workshop available to the Board.

 

The Board reviewed the draft of the May quarterly report to the Select Board.  Chris Haggerty made a motion to forward the report to the Select Board.  Rodney Pingree seconded the motion.  All were in favor.

 

Agenda Item #3 – CCRP Representative

The CCRP representative was unable to attend the meeting to review the CCRP Open Space Maps.  The representative will be invited to attend the June meeting of the Planning Commission.

Agenda Item #4 – Zoning Regulation Amendments  (additions are in Italics)

a.      Density Village II – review changes.  The Board reviewed the changes that were made at the April meeting.  It was noted that where the extended AG/RU - I District meets Joiner Brook, the boundary line is perpendicular to the road, extending out 1300 feet.

 

b.      Four items from Brian Hehre’s memo (issues to be addressed list #3).

  1. C.O.C. more strictly enforced – site visit by ZA necessary when foundation poured.  Linda Baker asked Dick Ward to draft an outline of the ZA’s standard operating procedures that would reflect this issue, rather than address it within the zoning regulations.

 

  1. Sewage Disposal Ordinance – make it clear that SDO must be obtained first.  No need for further change, language is clear.

 

  1. Right-of-way clarification – No need for further change, language is clear.

 

  1. Sewage Ordinance – No need to be addressed at this time.

 

c.      Number of homes on a private road – The Commission revisited the issue and concluded that the number of homes allowed on a private road was not the issue, the road standard was the issue.  The Commission reviewed changes made under Section 12, a and b, and concluded that there was no need for further change.

 

d.      Placement Issues.

  1. Unregistered vehicle storage – Amy Grover will check the current status of a separate ordinance.

 

Agenda Item # 5 - Any Other Business.

Dick Ward stated that he had received a call from Carl Jerentkoff, State employee, who had noticed the monitoring wells in place on the DesLauriers property along Route 2 (the previous Bolton Driving Range location).  Mr. Jerentkoff wanted to ascertain that the Town realized that the area was Winooski River flood plain.  The Commission reviewed the Flood Plain District Map and the Flood Hazard Zoning Bylaw.  After discussion the Board moved the “Flood Area Zoning Bylaw” from Article V, Section 7, page 18, to Article III, Section 7, page 8 , and to read as follows:

“All development and any activity, which is governed by this ordinance, shall be in conformance with the Town of Bolton Flood Hazard Area Bylaw, adopted 10/2/89, which is available at the Town Office.  The Flood Insurance Rate Map, slide/map 19 is available at the Town Office for review.  Development in the flood plain requires an additional permit as per the Flood Hazard Area Zoning Bylaw.  Such development is subject to review as a conditional use under this ordinance.”

 

Amy Grover will provide a current draft of the Zoning Regulations to the Commission at the June meeting.

 

Amy Grover will check with Deb LaRiviere concerning “vault copies” of all ordinances, check on the status of the junk vehicle ordinance, and ask Deb/Select Board to explore the possibility of having an item on the March 2003 Town Meeting ballot which would allow the Select Board to adopt ordinances without a vote from the residents of Bolton.

 

The next  scheduled meeting of the Planning Commission will be on Wednesday, June 12, 2002, 6 p.m. at the Town Office.
