Call to Order

Rob Heimbuch called the hearing to order at 7:00 p.m. and swore in all that would be giving testimony.

 

Agenda Item #1 – Gosselin Variance

This hearing was convened to consider the appeal of Peter and Kelly Gosselin of 123 Mountain View Drive seeking a variance from Section 3, sub-section D, Dimensional Requirements of the Bolton Zoning Regulations.  Request is for permission to construct a 12’ x 12’ deck to within twenty-three (23) feet of the required rear yard, located at 123 Mountain View Drive, Tax Map Parcel ID # 05-011.000

 

Pete Gosselin, landowner, appeared on behalf of the application.

 

Dick Ward noted that the required rear setback in the Agriculture and Rural I District was 35 feet for the rearyard.  Rob Heimbuch noted that if the variance were granted, the rearyard setback would be 23’.

 

Rob Heimbuch asked for information regarding the proposed deck.

 

The Board and Mr. Gosselin reviewed the map of the property.  Mr. Gosselin stated that it was 35’ from the back of his house to the rear property line.  He added that the front of the house faces I-89 and the road, where there was no privacy, and that he and his family would like to build a 12’ x 12’ deck on the rear of the house.  Mr. Gosselin noted that a previous owner had acquired a permit to construct a back deck in 1994, but that the deck was never built.

 

Rob Heimbuch asked what the property behind the rear line contained.  Mr. Gosselin stated that it was open mowed lawn, that the adjoining property owners all mow into the center area and create an open green space.

 

Susan Vita asked how the neighbors felt about the proposed deck. Bill Bullock stated that he was at the hearing to support the Gosselin’s request, that the deck would not be a problem whatsoever, that he felt it would not encroach onto his property.

 

Greg Swan asked where the houses of the neighbors were in relation to the proposed deck.  Mr. Gosselin reviewed their placement on the map.  Mr. Bullock added that all of the houses in that area pre-date zoning regulations, and are all close to property lines.

 

Greg Swan asked if the abutters were notified of the hearing.  Amy Grover replied that hearing notices were sent to all of the abutters.

 

Rob Heimbuch asked if there were any other questions or comments.  There were none.

Rob called for a motion.  Greg Swan made the motion to approve Pete Gosselin’s appeal for a variance from Article III, Section 3, subsection D, Dimensional Requirements.

 

Susan Vita seconded the motion.

 

All were in favor.

Rob Heimbuch signed the Blow minor subdivision Mylar, prepared by David A. Tudhope and dated 9/11/03.
