FINDINGS OF FACT AND NOTICE OF DECISION

 

This matter came before the Development Review Board on the application of Wayne Deslauriers of 30 Champ Lane seeking a variance from Section 2; sub-section D, Dimensional Requirements of the Bolton Zoning Regulations.  Request is to extend the footprint of an existing garage to within 19’ of the side yard (minimum 25’)

 

The DRB conducted a duly warned public hearing on September 15, 2004.  Present at this hearing was applicant, Wayne Deslauriers.  Based upon the testimony provided at the hearing and the submission of documents for this application, the DRB finds and decides as follows:

 

FINDINGS OF FACT

 

1.     The property in question is zoned Village I.

 

2.     Dimensional Requirements: front yard thirty (30) feet, and side yard twenty five (25) feet.  Proposed by appellant; nineteen (19) for side yard.

 

3.     The existing garage (22’ x 24’) is in disrepair and should be demolished.  The applicant is requesting to increase the footprint of the garage to 26’ x 30’ which creates a nineteen (19) foot side yard.

 

4.     Certain existing site improvements (i.e. a swimming pool and the existing driveway) create a hardship with a twenty five foot side yard.

 

5.     Existing large trees on the site would have to be removed.

 

6.     The side yard in question does not abut any other construction.

 

7.     The adjoining property owners have no objections to the proposal.

 

8.     The variance will not alter the character of the neighborhood.

 

9.     The variance represents the minimum variance to afford relief.

 

 

DECISION

 

Based upon the Findings set forth above, the DRB unanimously approves the request as submitted, with no conditions.
