TOWN OF BOLTON
DEVELOPMENT REVIEW BOARD
FINDINGS OF FACT AND NOTICE OF DECISION
This matter came before the Development Review Board on the application of the Town of Bolton, Deb LaRiviere, agent, 3045 Theodore Roosevelt Highway seeking a variance from Section 8, Non-complying structures, extensions, of the Bolton Zoning Regulations. Request is for permission to construct a 10’ x 10’ mudroom entry with a handicapped ramp to within twenty (20) feet of the required front yard, located at the Town Offices, 3045 Theodore Roosevelt Highway.
The DRB conducted a duly warned public hearing on November 19, 2003. Present at this hearing on behalf of the application was the agent for the Town of Bolton, Deb LaRiviere, and Tina Atwood. Based upon the testimony provided at the hearing and the submission of documents for this application, the DRB finds and decides as follows:
1. The property in question is zoned Village I District.
2. Minimum required frontyard setback is thirty five (35) feet, existing frontyard setback is thirty (30) feet, proposed frontyard setback twenty (20) feet.
3. The Town Fire Station is also constructed on the same lot.
4. Existing structure is non-conforming. Any alterations would be prohibited.
5. Proposed addition will serve as an enclosed entry with some storage area, with a handicapped ramp.
6. Lot is very narrow, only seventy-five (75) feet wide.
7. The rearyard abuts the railroad tracks; therefore a rear addition is not possible.
8. Addition as proposed will be constructed as a suitable renewable energy resource structure.
9. Addition will provide for a better handicap access during the winter months.
10. Buildings is used as town offices, and have outgrown the space, relocation at this time is not an option.
11. Variance represents a minimum waiver to afford relief and will not alter the character of the neighborhood.
Based upon the Findings set forth above, the DRB unanimously approves the request as submitted, with no conditions.
