DEVELOPMENT REVIEW BOARD
FINDINGS OF FACT AND NOTICE OF DECISION
This matter came before the Development Review Board on the application of Peter and Kelly Gosselin of 123 Mountain View Drive seeking a variance from Section 3, sub-section D, Dimensional Requirements of the Bolton Zoning Regulations. Request is for permission to construct a 12’ x 12’ deck to within twenty three (23) feet of the required rear yard, located at 123 Mountain View Drive, Tax Map Parcel ID # 05-011.000
The DRB conducted a duly warned public hearing on October 15, 2003. Present at this hearing was applicant, Pete Gosselin. Based upon the testimony provided at the hearing and the submission of documents for this application, the DRB finds and decides as follows:
1. The property in question is zoned Agriculture and Rural I District.
2. Minimum rear yard required thirty-five feet, proposed by appellant; twenty-three feet.
3. Lot size .91 acres with a frontage of approximately 220 feet.
4. Proposed addition 12’ x 12’ deck on the rear of the house. No opposition from any neighbors.
5. Existing lot is non-complying to dimensional (lot size) requirements.
6. Property line adjustment (by State) created an irregular shaped parcel.
7. Adjoining property owner not opposed to the proposed deck.
8. Hardship not created by appellant, variance will not alter the character of the neighborhood.
9. Represents the minimum variance to afford relief.
Based upon the Findings set forth above, the DRB unanimously approves the request as submitted, with no conditions.
