DEVELOPMENT REVIEW BOARD
FINDINGS OF FACT AND NOTICE OF DECISION
This matter came before the Development Review Board on the application of Jeff Garfield, 1812 Theodore Roosevelt Highway, for a variance from Article III, Section 3, sub-section D, Dimensional Requirements – minimum side yard fifty (50) feet and minimum rear yard thirty five (35) feet. Minimum lot size 2 acres. Proposed is the construction of a 24’ x 24’ detached garage to within fifteen (15) feet of the rear yard and eighteen (18) feet of the side yard. Applicant’s lot contains 22, 500 square feet.
The DRB conducted a duly warned public hearing on April 16, 2003. Present at this hearing was applicant, Jeff Garfield. Based upon the testimony provided at the hearing and the submission of documents for this application, the DRB finds and decides as follows:
1. The property in question is located in the Agriculture and Rural I District.
2. Jeff and Kathy Garfield occupy the property as residential use.
3. A variance from Article III, Section 3, sub-section D, Dimensional Requirements requires approval by the DRB.
4. Driveway location would require that any garage location would result in a variance.
5. The size of the lot prevents construction of any structure in compliance with dimensional requirements.
6. The placement of other structures prevents construction of a garage in compliance.
7. The applicant operates his own business and needs the garage for two vehicles; existing garage is only a one-vehicle structure.
8. No business materials will be stored on site, and no plumbing or drains installed in proposed garage.
9. The existing garage will be converted into additional living area in the future.
10. No opposition from any neighbors.
11. Character of the neighborhood should not be affected by the construction of the proposed garage.
12. Represents the minimum variance to allow relief.
13. The proposed addition will not place any additional demands on Town services.
14. Hardship created by others, setting off a sub-standard lot (less than 1/2/acre).
Based upon the Findings set forth above, the DRB unanimously approves the request as submitted.
