DEVELOPMENT REVIEW BOARD
NOTICE OF DECISION
This matter came before the Development Review Board (DRB) on the application of Bolton Valley Holiday Resort, Inc., Ned Hamilton (Landowner and Applicant) for final plat approval for a three (3) lot subdivision of Bolton Valley Holiday Resort, Inc. located on the Bolton Valley Access Road, prepared by Bernie Chenette, Chenette Associates, and Chase and Chase dated 12/12/02. The proposal includes division of parcel #1 containing 142 acres to be conveyed to Silver Bow Communications, Inc., parcel #2 containing 1,130 acres to be conveyed to Green Mountain Club, Inc. and the balance of the land containing 3,398 acres to be retained.
The DRB conducted a duly warned hearing on January 22, 2003. Appearing on behalf of the application were Bernie Chenette for Bolton Valley Holiday Resort, Susan Shea for the Green Mountain Club, and James Caffry, Esq. for Silver Bow Communications, Inc. Based upon the testimony provided at the public hearing and the documents submitted to the DRB (contained in the documents of file for this application), the DRB decides as follows:
The DRB unanimously approves the Applicant’s request for final plat approval for a three (3) lot subdivision located on the Bolton Valley Access Road with the following conditions:
1. That the applicant acquires all permits necessary under Act 250.
2. That the subdivision Mylar be recorded in compliance with the Town Clerk’s requirements within ninety (90) days of subdivision approval.
3. Prior to any subsequent conveyance of the 1,130-acre parcel to the State of Vermont, the Green Mountain Club shall notify, in writing, the Vermont Department of Fish & Wildlife of the concerns of the Town of Bolton regarding the potential increased use of the 1,130-acre parcel for hunting in close proximity to the ski resort.

January 22, 2003, subject to the requirements and conditions of said resolution.
