NOTICE OF DECISION
This matter came before the Development Review Board on the application of Mark and Tina Atwood for a variance from Article IV, Section8, alterations of non-complying uses. Proposed is the construction of a 16’ x 28’ addition at 95 Champ Lane.
The DRB conducted a duly warned public hearing on April 24, 2002. Present at this hearing was applicant, Tina Atwood. Based upon the testimony provided at the hearing and the submission of documents for this application, the DRB finds, concludes, and decides as follows:
1. The property in question is located in the Village I District.
2. The property is occupied by Mark and Tina Atwood, as residential and commercial uses.
3. Section 8, Article IV concludes that alterations to a non-complying use require review and approval by the DRB.
4. Water and sewer are both private and will not place any demand on public services.
5. The proposed addition will not place any additional demands on Town services.
1. The proposed addition will serve as a customer service area.
2. The Atwood’s insurance company requests that customers be separated from the work area.
3. Existing use pre-dates zoning constructed in 1981.
4. The proposed addition will not affect the general character of the area and will not have any adverse effects on local roads in the vicinity.
Based upon the Findings and Conclusions set forth above, the DRB unanimously approves the request as submitted.
