TOWN OF BOLTON
INTERIM ZONING BY-LAW
1. PURPOSE
The Town of Bolton Zoning Ordinance establishes a Village II District for the purpose of allowing a development of seasonal and year-round homes associated with a master planned commercial ski and recreation operation and village. At present, the future of the commercial ski and recreation development located in the District is uncertain.
This interim zoning by-law is adopted to maintain the status quo in the Village II District while the Town reviews the land and development within the district to plan for its future use and development. Among other things, this interim bylaw shall maintain open space and wildlife habitat, and limit road construction and residential development, until the Town completes such review.
2. DESCRIPTION OF DISTRICT
This interim zoning by-law shall apply to those lands in the Town known as the “Village II District”, as defined by the Bolton Zoning Ordinance and described on the Official Map.
3. LIMITATIONS ON DEVELOPMENT
a) Permitted uses shall be those set forth in Section 2.B 1-6 of the Bolton Zoning Ordinance.
b) Conditional uses shall be those set forth in Section 2.C 1-7 of the Bolton Zoning Ordinance.
c) No more than one (1) principal structure shall be allowed per lot in the Village II District, except in a planned unit development (which shall not contain a residential component). For the purposes of this provision “principal” shall mean the main or primary structure on a lot, and shall not include any “accessory” structure, as defined in the Zoning Ordinance.
d) Dimensional Requirements shall be as follows:
1) Minimum lot size for all uses shall be ten (10) acres
2) Minimum road frontage on an approved town road shall be three hundred (300) feet.
e) Any pre-existing lot that meets the minimum lot size requirement of the permanent bylaw, that has either been developed with functioning water supply and waste waster disposal systems connected to the so-called “Bolton Valley systems” or that has been granted rights to connect to such systems prior to the adoption of this Interim Bylaw, shall be exempt from the dimensional requirements set forth in Item 3 (d), above.
4. EFFECTS ON EXISTING ORDINANCES:
This interim zoning bylaw shall not repeal any existing bylaws, regulations or ordinances of the Town of Bolton. This bylaw establishes restrictions that are in addition to those contained in any other town ordinance, bylaw or regulation.
5. AUTHORITY AND EFFECTIVE DATE:
This interim zoning bylaw is adopted pursuant to 24 V.S.A. Section 4410, as amended from time to time, and shall be effective upon passage.
