MINUTES FROM THE AUGUST 18, 2003 BOARD OF ABATEMENT

 

Board members present were Paula Gervia, Theresa Stockwell, Joan Pecor, Brenda McKeown, Tina Atwood, Dave Johnson, Deb LaRiviere, Jerry Mullen and Pete Siegel. The meeting was called to order at 5pm.

 

The Board reviewed the request of William Burnett to abate $41.43 tax and interest. Dave motioned: “To not abate the tax and interest due from William Burnett.” Seconded by Brenda. Burnett’s envelope was postmarked May 16, 2003. According to the Town of Bolton Tax Policy, there are no extensions on the fourth installment.  There was no other discussion, all were in favor, motion passed.

 

The Board reviewed a request from the Chittenden Bank for abatement of Scott Lamoth and Rae Ann Couture. Lamoth and Couture’s taxes were paid by the Chittenden Bank and received after the May 15th. due date. The bank paid the interest and penalty but is requesting a refund of those fees. Pete motioned: “Not to refund the tax and interest on the two above accounts to the Chittenden Bank.” Dave seconded. There was no discussion, all were in favor, motion passed.

 

The Board reviewed the request of John Larkin for abatement of tax penalty and interest. Larkin purchased the building rights to the remaining Bear Run condo unit approximately twelve years ago. After ten years, the building rights lapsed. We continued to bill Larkin for the value of the right to build for another year. This amount represents the year billed in error. Pete motioned: “To abate the tax, penalty and interest of John Larkin.” Brenda seconded. There was no other discussion, all were in favor, motion passed.

 

The Board reviewed the request of Laurel and Ed Pierpont for abatement of interest and tax. The Pierpont’s mailed their tax check on May 09, 2003 (see postmark) to the Town at the correct address. The check, made out to the Town of Bolton, was somehow received by Citizen’s Bank in Maine. Citizen’s cashed the check. Seven days later, the bank realized the error and sent their check to the town. Subsequently, interest and penalty was added to Pierpont’s account. Pete motioned: “To abate the tax and interest due from the Pierponts.” Seconded by Dave. There was no other discussion, all were in favor, motion passed.

 

There was no other business to be brought before this Board at this time. Paula motioned to end the meeting, seconded by Jerry. The meeting ended at 5:15pm.
